This User Agreement governs your use of the VibeShift application on your iPhone or iPad. By downloading, installing, or using the App, you agree to be bound by all the terms and conditions outlined in this Agreement. If you do not agree to these terms, please do not download, install, or use the App.
VibeShift is a local AI creative application designed to help users generate winter-style portrait images and short portrait motion clips. The App features a built-in AI model that operates entirely on your local device, allowing you to transform portrait photos into winter snow scene images or create short video clips without relying on external servers or complex editing tools. All content processing, generation, and storage are completed locally on your device, ensuring full control over your creative works.
It is important to note that the App does not collect any form of facial information from you or your content. This includes, but is not limited to, facial biometrics, face templates, facial feature points, facial contours, or any other data related to your face. The App never extracts, analyzes, stores, or shares any facial data from the photos you upload, the works you generate, or any other content you interact with. All facial elements in your content remain exclusively on your device, and we have no access to or control over any facial information.
The App does not require you to register a user account, create a profile, or provide any personal identification information (such as a phone number, email address, social media account, or any other personal data) to access or use its features. You can open and use all functions of the App immediately after downloading and installing it, with no identity verification, information input, or account binding required.
There is no user account system within the App, and no data synchronization between different devices. All your usage activity, creative content, and App preferences are stored only on the device you are using, and no information is linked to any personal account or identity.
Since no account is required, there is no mechanism for the App to collect, link, or store any facial information associated with a user profile. We do not request or gather any data that could connect facial features to your identity, and we never create facial profiles, biometric records, or any other form of facial-related data for any user. All your content and activity remain local to your device, with no facial data being collected or retained in any way.
The App only requests two permissions from your device: access to your photo library and access to your camera. These permissions are only requested when you actively choose to select a photo from your library or take a new photo using your camera for AI creation. The App will never request these permissions without your explicit action, and you have the right to revoke or deny these permissions at any time through your device’s settings.
When you grant photo library or camera access, the App will only use the specific photos you select to complete the AI creation process you request. The App will not access, read, scan, or use any other photos, files, or data from your device’s photo library or camera without your explicit permission.
The App does not collect any facial information through these permissions. We do not use the permissions to scan for, extract, or analyze facial data, nor do we classify or label photos based on facial features. The built-in AI model only uses the overall image content for style conversion or video generation, without focusing on or extracting any facial details. All facial content in the photos you select remains local to your device, and we never upload, store, or process any facial data from these images.
All content related to your use of the App—including the original photos you select, the winter-style images generated by the AI, the short motion clips you create, your App preferences, and any browsing or management history—is processed and stored exclusively on your iPhone or iPad. The App does not offer cloud storage, and no content is ever uploaded to external servers, our servers, or any third-party platforms.
You have full control over all your creative content in the App’s Works gallery. You can browse, preview, filter, save, share, or delete your creations at any time. When you delete a work from the Works gallery, it is permanently removed from your device’s local storage, with no residual files, caches, backups, or traces left behind. The App will not automatically save, back up, or restore any of your content without your explicit action.
The App does not collect, store, or process any facial information in the local content processing or storage process. We do not create any database of facial information, nor do we retain facial data in caches, logs, or temporary files. We do not analyze your creative content to identify facial features, track facial preferences, or build facial profiles. All facial content in your stored works is entirely under your control, and you can delete it permanently at any time—we have no way to retrieve, access, or recover any deleted facial-related content.
All AI models used by the App are built directly into the App and run exclusively on your local device. No internet connection is required to use the AI features, as all style conversion (Image to Image) and video generation (Image to Video) processes are completed locally on your device. The AI model focuses on adjusting the overall style, light, atmosphere, and motion of your photos to create the desired winter scene or motion clip, without any focus on or extraction of facial details.
For the Winter Portrait (Image to Image) feature, the AI model transforms your portrait photo into a winter snow scene by adjusting the background, light, and color scheme—never by extracting or analyzing facial features. For the Motion Clip (Image to Video) feature, the AI generates short videos by adding gentle motion to the overall image based on the text instructions you enter, without targeting or modifying facial features specifically.
The AI model does not contain any code or functionality designed to collect, analyze, or process facial information. It does not identify facial regions in your photos, extract facial biometrics (such as skin texture, eye shape, or facial expressions), or use facial data to train or improve the AI model. The sole purpose of the AI is to enhance the visual style and motion of your photos, and it never interacts with or processes any facial information in your content.
All creations you generate with the App are private and remain in your device’s local Works gallery by default. The App will never automatically share, publish, export, or distribute your content to any third-party platforms, social media, or external services. All sharing and export actions are initiated and controlled entirely by you—you can choose to save your works to your device’s photo library or share them through your device’s built-in sharing tools.
When you share or export your content, the App only provides the final generated image or video file to the platform or service you select. We do not intercept, record, track, or store any content you share, nor do we collect any data about your sharing activities, including the recipients of your shared content.
The App does not collect any facial information during the sharing or export process. We do not scan or extract facial data from the content you share, nor do we track your sharing activities based on facial features. We do not collect any information about the recipients of your shared content, and we never use facial information to influence or monitor your sharing behavior. All facial content in your shared works remains under your control, and we have no involvement in the circulation or use of that content after you share it.
The App does not integrate any third-party services, including but not limited to third-party analytics tools, advertising plugins, data collection tools, social media integrations, or third-party SDKs (Software Development Kits). We do not share any of your data, content, device information, or usage activity with any third-party companies, organizations, or individuals.
We do not sell, rent, exchange, disclose, or otherwise transfer any of your local content, device data, or usage information to any third parties. There are no data sharing agreements, partnerships, or arrangements that would allow third parties to access your content or any information related to your use of the App.
We never share any facial information with third parties, as we do not collect any facial information in the first place. There are no third-party services or partners that have access to facial data from the App, and we have no mechanism to share facial information even if we wanted to. All facial content remains entirely on your device, isolated from all third-party access.
When using the App, you agree to the following responsibilities: (1) You are solely responsible for the photos you upload and the content you generate using the App; (2) You ensure that you have the right to use any photos you upload (including any facial content in those photos) and that their use does not violate the rights of any third party (such as copyright, privacy rights, or publicity rights); (3) You will not use the App to generate or share content that is illegal, harmful, offensive, or infringing on the rights of others; (4) You will not attempt to modify, reverse engineer, decompile, or tamper with the App’s code, AI models, or local storage systems; (5) You will not use the App in any way that could damage, disable, overburden, or impair the App or your device.
You acknowledge that the App does not collect any facial information from your content, and you are solely responsible for any facial content in the photos you upload and share. We are not liable for any claims, damages, or disputes arising from the facial content in your photos or your use of that content.
We may occasionally release updates to the App, including bug fixes, feature improvements, and performance optimizations. These updates may be automatically downloaded and installed on your device, or you may be prompted to download and install them manually. By continuing to use the App after an update, you agree to the updated version of the App and any changes to this Agreement that may accompany the update.
Any updates to the App will not include features or functionality that collect, process, or store facial information. Our core commitment to not collecting any facial information will remain unchanged in all App updates, and we will never add any code or tools designed to gather facial data.
You may terminate this Agreement at any time by uninstalling the App from your device. We may terminate this Agreement and your access to the App if you violate any of the terms outlined in this Agreement. Upon termination, all content stored in the App’s Works gallery will remain on your device (unless you choose to delete it), and we will not have access to or control over any of your content.
Termination of this Agreement does not affect our commitment to not collecting any facial information. We will not retain any facial data (as we never collected any in the first place), and all facial content in your local storage will remain under your control.
